These Terms of Use (“Terms”) govern your access to and use of the MapFluence™ platform, website located at https://mapfluence.dev, and all related software, services, and tools (collectively, the “Services”).

By accessing or using the Services, you agree on behalf of yourself and your organization (“you,” “your,” or “Customer”) to be bound by these Terms. If you do not agree, you may not use the Services.

1. License & Access

1.1 Limited License

MapFluence™ grants you a limited, non-exclusive, non-transferable license to access and use the Services during your active period in accordance with your selected plan.

1.2 Restrictions

You agree NOT to:

  • Copy, resell, or distribute the Services
  • Reverse engineer or attempt to extract source code
  • Modify or create derivative works
  • Use the platform for unlawful or abusive purposes
  • Provide the Services to third parties without authorization (unless part of an approved partner/agency program)

1.3 Updates & Support

We may:

  • Add, remove, or modify features at any time
  • Improve performance and functionality

We do not guarantee response times but aim to provide timely assistance.

1.4 Account Responsibility

You are responsible for:

  • Maintaining account security
  • All activity under your account
  • Ensuring accurate login and billing information
  1. Billing & Cancellation

2.1 Billing

  • Billed monthly in advance
  • Payments are processed via third-party providers.
  • All payments are non-refundable, unless required by law

2.2 Auto-Renewal

Subscriptions automatically renew unless canceled before the next billing cycle.

You may cancel:

  • Inside your dashboard
  • Or via email at contact@mapfluence.dev

2.3 Pricing Changes

We may update pricing at any time. Changes take effect on your next billing cycle.’

2.4 Taxes

You are responsible for any applicable taxes, duties, or fees associated with your use of the Services.

  1. Termination & Suspension

3.1 Your Cancellation

You may cancel at any time. Access continues until the end of your billing period.

3.2 MapFluence™ Rights

We may suspend or terminate access if:

  • You violate these Terms
  • Your activity poses legal, security, or platform risk
  • Fraudulent or abusive behavior is detected

3.3 Effect of Termination

Upon termination:

  • Access to Services ends
  • No refunds are issued
  • Certain provisions (IP, liability, etc.) survive termination

4.1 Ownership

MapFluence™ owns all rights, title, and interest in:

  • The platform
  • Software
  • AI systems
  • Content and technology

These Terms do NOT transfer ownership.

4.2 Feedback

Any feedback you provide may be used by MapFluence™ to improve the platform without compensation or obligation.

5. Data & Privacy

5.1 Privacy Policy

Your use of the Services is subject to our Privacy Policy.

5.2 Data Usage

We may use aggregated, anonymized data to:

  • Improve the platform
  • Develop new features
  • Analyze performance

5.3 Google & Third-Party Integrations

MapFluence™ integrates with platforms like:

  • Google Business Profile
  • Google APIs

We:

  • Do NOT use Google data to train AI models
  • Only use data to deliver core functionality
  • Comply with all applicable platform policies
  1. Customer Responsibilities

You represent and warrant that:

  • You have the legal right to use the Services
  • You have permission to manage business data/accounts
  • You comply with all applicable laws and platform policies
  • You will not upload malicious or harmful code
  1. Disclaimer

THE SERVICES ARE PROVIDED “AS IS.”

MapFluence™ makes no guarantees regarding:

  • Performance
  • Rankings or search visibility
  • Uninterrupted or error-free operation

We are not liable for:

  • Data loss
  • Platform interruptions
  • Third-party integrations
  • Any indirect or consequential damages
  1. Limitation of Liability

To the maximum extent permitted by law:

The total liability will not exceed:
 The amount you paid in the previous 30 days

We are not liable for:

  • Lost revenue or profits
  • Business interruption
  • Indirect or incidental damages
  1. Indemnification

You agree to defend and indemnify MapFluence™ against any claims arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your misuse of data or third-party platforms
  1. Confidentiality

You agree to keep confidential all proprietary information related to MapFluence™, including:

  • Platform features
  • Pricing
  • Technology
  • Internal processes
  1. Governing Law & Arbitration

These Terms are governed by the laws of the State of Wyoming.

All disputes will be:

  • Resolved via binding arbitration in Wyoming.
  • Handled individually (no class actions)
  1. Miscellaneous

12.1 No Assignment

You may not transfer these Terms without our consent.

12.2 Use of Name

We may use your business name/logo for:

  • Case studies
  • Marketing materials

12.3 Force Majeure

We are not liable for delays caused by events beyond our control.

12.4 Entire Agreement

These Terms represent the full agreement between you and MapFluence™.

12.5 Changes to Terms

We may update these Terms at any time. Continued use means acceptance.
